Working on Public Holidays: How Much Salary Do Employees Receive?
According to the provisions at Point c, Clause 1, Article 98 of the Labor Code 2019, regulations on overtime pay, night work pay, are as follows:
Employees who work overtime are paid wages calculated according to the wage unit price or actual wages paid according to the work being performed as follows:
On holidays, Tet, paid leave days, at least 300% not including wages for holidays, Tet, paid leave days for employees receiving daily wages.
=> Thus, according to the above-mentioned provision, in the case of holidays and Tet according to the labor law, the employee will be entitled to paid leave. If working on these days, the employee will receive the full wage plus 300% of the wage according to the wage unit price or wage according to the work that the employee is performing.
And in Article 112 of this Code, it is stipulated: Employees are entitled to leave, to receive full pay during the following holidays and Tet:
- New Year's Day: 01 day (January 01 of the solar calendar);
- Lunar New Year: 05 days;
- Victory Day: 01 day (April 30 of the solar calendar);
- International Labor Day: 01 day (May 01 of the solar calendar);
- National Day: 02 days (September 02 of the solar calendar and 01 adjoining day before or after);
- Hung Kings' Commemoration Day: 01 day (March 10 of the lunar calendar).
