Working in a Type 3 Commune: Eligibility for Initial Allowance?
According to Decree 05/2020/ND-CP, the regulation regarding Type 3 communes has been abolished.
Based on Clause 2, Article 1 of Decree 76/2019/ND-CP, officials are entitled to receive initial allowance when working in one of the following areas:
- Truong Sa, Hoang Sa, DK1 archipelago districts;
- Type III communes in ethnic minority and mountainous areas, or especially difficult island communes as per the Decision of the Prime Minister of the Government of Vietnam;
- Particularly difficult hamlets, villages, xoms, ban, langs, phums, socs, apts, etc. (collectively referred to as hamlets) as per the Decision of the Prime Minister of the Government of Vietnam.
Thus, if an official works in a Type 3 commune belonging to one of the above-mentioned areas, their initial work period in this area will qualify them to receive an initial allowance according to Decree 76.
