Work Shifts and Organization of Shift Work
Article 63 of Decree 145/2020/ND-CP (Effective February 01, 2021) stipulates about work shifts and the organization of shift work as follows:
A work shift is the period during which an employee works from the time they start their task until they finish and hand over the task to another person. This period includes both working time and break time.
The organization of shift work involves arranging at least two individuals or two groups of people to take turns working at the same position within a 24-hour period (one day).
Continuous shift work to be considered for break time during working hours as stipulated in Clause 1, Article 109 of the Labor Code is the case of shift work organization stipulated in Clause 2 of this Article when the shift meets the following conditions:
a) The employee works in the shift for 6 hours or more;
b) The transition time between two consecutive shifts does not exceed 45 minutes.
