Will the Trade Union Law 2024 in Vietnam be effective from July 1, 2025?

The Trade Union Law 2024 was passed by the National Assembly of the Socialist Republic of Vietnam, Session XV, 8th meeting session, on November 27, 2024.

The Trade Union Law 2024 stipulates the functions, duties, rights, and responsibilities of Vietnam's Trade Union; the right of workers to form, join, and operate trade unions; the joining of the Vietnam Trade Union by worker organizations at enterprises; the rights and responsibilities of trade union members; the responsibilities of the State, agencies, organizations, units, enterprises, and employers toward the Trade Union; ensuring the operation of the Trade Union; resolving disputes and handling violations of trade union laws.

The Trade Union Law 2024 applies to trade unions at all levels, state agencies, political organizations, socio-political organizations, socio-political-professional organizations, socio-professional organizations, units, enterprises, other organizations employing labor as prescribed by labor law, foreign agencies and organizations, international organizations operating in the territory of Vietnam (collectively referred to as agencies, organizations, units, enterprises); worker organizations at enterprises, trade union members, workers, and other organizations and individuals related to the organization and operation of trade unions.

The Trade Union Law 2024 takes effect from July 1, 2025.

What are levels of the Vietnam Trade Union?

Pursuant to Article 8 of the Trade Union Law 2024, the organizational structure of the Vietnam Trade Union is regulated as follows:

Article 8. Organizational Structure of the Vietnam Trade Union

  1. The Vietnam Trade Union is a unified organization comprising four levels as follows:

a) The central level is the Vietnam General Confederation of Labor.

b) The provincial level, central sector, and equivalent trade unions include the labor federations of provinces and centrally run cities (hereinafter referred to as the provincial labor federation); central sector trade unions; economic group trade unions, corporation trade unions under the Vietnam General Confederation of Labor.

c) The level directly above the grassroots level includes district, district-level town, city in provinces, and centrally run city labor federations (hereinafter referred to as district labor federation); local sector trade unions; economic group trade unions, corporation trade unions not covered under point b of this clause; trade unions of industrial zones, export processing zones, economic zones, high-tech zones; other direct-level trade unions according to the Charter of the Vietnam Trade Union.

d) The grassroots level trade unions include grassroots trade unions, grassroots unions.

  1. The Vietnam General Confederation of Labor decides on the formation and determines the level of trade unions for administrative-economic special unit trade unions based on the National Assembly's decision on establishing administrative-economic special units.

Thus, the Vietnam Trade Union system has 04 levels as follows:

What are rights of trade union members in Vietnam?

Pursuant to Article 21 of the Trade Union Law 2024, the rights of trade union members are regulated as follows:

- Request the Trade Union to represent and protect legal and legitimate rights and interests when infringed.

- Be informed, discuss, propose, and vote on the Trade Union's work.

- Be propagated and informed about the Party’s policies, the State’s laws related to trade unions, workers, and the Trade Union’s regulations.

- Run for election, nominate, and vote for the leadership of the Trade Union according to this Law and the Charter of the Vietnam Trade Union.

- Question trade union leaders at all levels, propose disciplinary actions for trade union officials who violate regulations under the Charter of the Vietnam Trade Union.

- Receive free legal support from the Trade Union on trade union law, labor, employment, social insurance, unemployment insurance, health insurance, occupational safety and hygiene, officials and public employees.

- Be counseled, guided, and supported by the Trade Union in finding jobs, vocational training, improving professional qualifications, occupational skills; receive visits, assistance when sick, maternity leave, difficulty, accident, and enjoy other welfare activities carried out by the Trade Union.

- Participate in cultural, sports activities, sightseeing, tours organized or coordinated by the Trade Union.

- Propose the Trade Union to recommend policies, laws concerning workers to agencies, organizations, units, enterprises, cooperatives, and cooperative unions.

- Enjoy social housing rental policies by the Vietnam General Confederation of Labor.

- Be commended and rewarded for achievements in labor, production, and trade union activities.

- Other rights according to relevant laws and the Charter of the Vietnam Trade Union.
