Who is the Contracted Service Provider?

Based on the provisions of Clause 8, Article 3 of Decree 152/2020/ND-CP:

A service provider under a contract is a foreign worker who has worked for at least 02 years (24 months) in a foreign enterprise that does not have a commercial presence in Vietnam and must meet the regulations for experts under Clause 3 of this Article.

To be specific::

- Have a university degree or higher or equivalent and have at least 3 years of work experience in the trained specialty suitable for the job position that the foreign worker is expected to work in Vietnam;

- Have at least 5 years of experience and have a practicing certificate suitable for the job position that the foreign worker is expected to work in Vietnam;

- Special cases shall be decided by the Prime Minister of the Government of Vietnam upon the proposal of the Ministry of Labor - Invalids and Social Affairs.

Thus, the service provider under the contract is determined based on the above criteria.
