When is the Company Required to Arrange Compensatory Time Off for Employees?
At Point c Clause 6 Article 106 of the Labor Code 2012 stipulates:
After each period of continuous overtime for many days in a month, the employer must arrange for the employee to take compensatory leave for the time not taken.
The compensatory leave period according to Point c Clause 2 Article 106 of the Labor Code is stipulated as follows (Article 4, Decree 45/2013/ND-CP):
a) After each period of maximum 07 continuous overtime days in a month, the employer must arrange for the employee to take compensatory leave for the time not taken;
...
Thus, according to the Labor Code, the employee will be arranged compensatory leave when: after each period of maximum 07 continuous overtime days in a month. During that time, in addition to the overtime pay, the company must arrange for the employee to take compensatory leave for the time not taken.
