What type of contract should be signed when seasonal contracts are no longer applied?
Based on Clause 1, Article 20 of the Labor Code 2019 stipulating the types of labor contracts as follows:
The labor contract must be concluded according to one of the following types:
- An indefinite-term labor contract is a contract in which the two parties do not determine the term, the time of termination of the contract's validity;
- A fixed-term labor contract is a contract in which the two parties determine the term, the time of termination of the contract's validity within a period not exceeding 36 months from the effective date of the contract.
Therefore, if you recruit for seasonal work, the parties must sign a fixed-term labor contract. The specific term of the contract is 3 months according to the above regulation.
