What Policies Do Civil Servants Who Resign Enjoy?
Clause 13, Article 7 of the Law on Officials, 2008
Resignation is defined as a leadership or managerial official's request to be relieved of their position before the end of their term or the appointment period.
According to Article 30 of the Law on Officials, 2008, officials are eligible to resign in the following cases:
- Insufficient health;- Inadequate capability or prestige;- As required by duty; and- For other reasons.
And according to Articles 42 and 44 of Decree 24/2010/ND-CP, the regime and policies for officials who resign are as follows:
- An official holding a leadership or managerial position who resigns to transfer leadership or managerial positions, or who finds themselves lacking sufficient health, capability, or prestige to fulfill their responsibilities, shall retain their current position allowance until the end of the specified term. If the remaining term is less than 6 months, they shall retain their current position allowance for 6 months from the date of the resignation decision.
- An official holding a leadership or managerial position who resigns upon recognizing mistakes or shortcomings of their organization, unit, or subordinate that relate to their responsibility, or who wishes to resign for other personal reasons, shall retain their current position allowance for a period of 6 months from the date of the resignation decision.
