What is the time limit to finalize the data of the Report on the situation of technical inspection of occupational safety in 2023 in Vietnam?

Pursuant to Clause 5 Article 10 of the Circular 01/2023/TT-BXD (effective from 10/03/2023) stipulating the time limit to finalize the data of the Report on the situation of technical inspection of occupational safety as follows:

5. Time to close report data: According to the provisions of Clause 4, Article 12 of Decree 09/2019/ND-CP.

Under Clause 4, Article 12 of Decree 09/2019/ND-CP stipulating as follows:

Time to close report data in periodical reporting mode

1. Monthly report: From the 15th day of the previous month to the 14th day of the month in the reporting period.

2. Quarterly report: From the 15th day of the month before the reporting period to the 14th day of the last month of the quarter in the reporting period.

3. Periodic report every 6 months: The time to close data for the first 6 months is from December 15 of the year before the reporting period to June 14 of the reporting period. The data closing time for the last 6 months of the year is from June 15 to December 14 of the reporting period.

4. Annual report: From December 15 of the year before the reporting period to December 14 of the reporting period.

5. For other periodical reports, the time for data closing shall be prescribed by the agency issuing the reporting regime, but must satisfy the provisions of Articles 5, 6, 7, 8 and 11 of this Decree.

Therefore, the time to close the data of the Report on the situation of technical inspection of occupational safety in 2023 is from December 15, 2022 of the reporting period to December 14, 2023.

What is the time limit to submit the Report on the situation of technical inspection of occupational safety in 2023 in Vietnam?

Report on the situation of technical inspection of occupational safety

1. Reporting basis: According to the provisions of Clause 2, Article 44 of Decree No. 44/2016/ND-CP dated May 15, 2016 of the Government detailing a number of articles of the Law on occupational safety and hygiene on technical inspection of occupational safety, training in occupational safety and hygiene and monitoring of the working environment.

2. Subjects of the report, the agency receiving the report, the process and time limit for sending the report:

The technical inspection organization of occupational safety is responsible for sending reports to the Ministry of Construction before December 15 of each year for synthesis and monitoring.

Thus, the technical inspection of occupational safety is responsible for sending the report on the status of technical inspection of occupational safety to the Ministry of Construction before December 15, 2023 for synthesis and monitoring.

What are responsibilities of Organization of technical inspection of occupational safety in Vietnam?

Pursuant to Article 15 of the Decree 44/2016/NĐ-CP (amended by Article 2 of the Decree 140/2018/NĐ-CP) stipulating as follows:

Responsibility of Organization of technical inspection of occupational safety

1. Releases the inspection record to the organizations and individuals using the machine, equipment and materials with strict requirement for occupational safety; affixes inspection stamp or indicates the inspection information on the inspected objects and issues the organization and individual using the inspected objects with the Certificate of inspection result (01 copy) within 05 working days from the date of release of record if the inspection result meets the requirements.

2. Where the inspected objects do not meet the requirements and are detected to possibly cause the occupational incidents or accidents, it shall not issue the Certificate of inspection result and notify the establishment for remedial actions.

4. Ensures the independence and objectiveness in supply of inspection services.

5. Sends its inspectors to attend the classes of inspection technique training of occupational safety.

7. Must not provide the inspection services during the time of being suspended or its Certificate of eligibility for technical inspection of occupational safety is revoked; must not employ the inspectors whose Certificate of inspector is revoked for inspection.

8. The form of Certificate of inspection result; form of inspection stamp and form of report on reality of inspection are specified in the Appendix Id issued with this Decree.

As regulations above, responsibilities of Organization of technical inspection of occupational safety in Vietnam are:
