Are employees in Vietnam entitled to fully paid days off November 11?
Pursuant to Article 112 of the Labor Code 2019 regarding holiday entitlements:
Article 112. Holidays
- Employees are entitled to fully paid days off during the following public holidays:
a) New Year's Day: 01 day (January 1 of the Gregorian calendar);
b) Lunar New Year: 05 days;
c) Victory Day: 01 day (April 30 of the Gregorian calendar);
d) International Labor Day: 01 day (May 1 of the Gregorian calendar);
dd) National Day: 02 days (September 2 of the Gregorian calendar and 01 adjacent day);
e) Hùng Vương Commemoration Day: 01 day (March 10 of the lunar calendar).
- Foreign employees working in Vietnam, in addition to the holidays specified in Clause 1 of this Article, are entitled to an additional 01 traditional national holiday and 01 national day of their country.
- Annually, based on practical conditions, the Prime Minister of Vietnam shall decide specifically on the holidays prescribed in Points b and đ Clause 1 of this Article.
According to the above regulations, employees are entitled to fully paid days off during the following days:
- New Year's Day: 01 day (January 1 of the Gregorian calendar)
- Lunar New Year: 05 days
- Victory Day: 01 day (April 30 of the Gregorian calendar)
- International Labor Day: 01 day (May 1 of the Gregorian calendar)
- National Day: 02 days (September 2 of the Gregorian calendar and 01 adjacent day)
- Hùng Vương Commemoration Day: 01 day (March 10 of the lunar calendar)
Additionally, foreign employees working in Vietnam are entitled to an additional 01 traditional national holiday and 01 national day of their country.
Thus, employees are not entitled to fully paid days off on November 11, unless November 11 coincides with a traditional national holiday or a national day for foreign employees working in Vietnam. In such cases, they would be entitled to leave on those days.
