What is the payment for working on weekly rest days?
According to Clause 2, Article 107 of the 2019 Labor Code, employers are only allowed to use employees for overtime work with the employees' consent (a written agreement is required).
Therefore, if the employees agree to work overtime, the company is permitted to use them for overtime on Saturdays.
Clause 1, Article 98 of this Code stipulates that employees working overtime shall be paid based on the unit price of wages or the actual wages paid for the work being performed as follows:
- On regular days, at least 150%;
- On weekly rest days, at least 200%;
- On public holidays, Lunar New Year holidays, and paid leave days, at least 300%, not including the wages for the holiday or paid leave day for employees receiving a daily wage.
Thus, since Saturday is a weekly rest day, employees shall be paid at least 200% based on the unit price of wages or the actual wages paid for the work being performed (Detailed calculation method: Clause 1, Article 55 of Decree 145/2020/ND-CP).
