Tết Trùng Thập, also known as Tết Song Thập (the 10th day of the 10th lunar month), is also called the festival of the healers or the New Rice Festival in October. This festival is also called Hạ Nguyên, in contrast to Thượng Nguyên (the 15th day of the Lunar New Year) according to Buddhist customs.

According to the book "Dược lễ", the 10th day of the 10th lunar month is an auspicious day when medicinal plants have accumulated the yin and yang energies and achieved the best of the four seasons' colors (Spring, Summer, Fall, Winter). Therefore, healers highly value this festival.

According to the universal calendar, Tết Trùng Thập in 2024 (the 10th day of the 10th lunar month) falls on Sunday, November 10, 2024, in the solar calendar.

Are employees in Vietnam entitled to a fully paid day off on Tết Trùng Thập?

Pursuant to Article 112 of the Labor Code 2019 regulating public holidays:

Article 112. Public Holidays

  1. Employees are entitled to leave with full pay on the following public holidays:

a) New Year's Day: 01 day (January 1 of the solar calendar);

b) Lunar New Year: 05 days;

c) Victory Day: 01 day (April 30 of the solar calendar);

d) International Labor Day: 01 day (May 1 of the solar calendar);

e) Hung Kings' Commemoration Day: 01 day (the 10th day of the 3rd lunar month).

  1. Foreign employees working in Vietnam, apart from the holidays specified in paragraph 1 of this Article, are entitled to an additional day of leave for their traditional national holiday and one for their national day.
  1. Annually, based on actual conditions, the Prime Minister of Vietnam decides the specific days of leave stipulated in points b and e of paragraph 1 of this Article.

According to the above regulations, employees are entitled to leave with full pay on the following holidays:

- New Year's Day: 01 day (January 1 of the solar calendar)

- Lunar New Year: 05 days

- Victory Day: 01 day (April 30 of the solar calendar)

- International Labor Day: 01 day (May 1 of the solar calendar)

- Hung Kings' Commemoration Day: 01 day (the 10th day of the 3rd lunar month)

In addition, foreign employees in Vietnam are entitled to an additional day off for their traditional national holiday and one for their national day.

Thus, on October 19, 2024, employees are not entitled to leave with full pay. However, since Tết Trùng Thập 2024 falls on a Sunday, it may coincide with the weekend, so many companies may allow employees to take a day off.

How many days of annual leave are employees engaged in particularly heavy, toxic, or dangerous occupations in Vietnam entitled to?

Pursuant to Article 113 of the Labor Code 2019 on annual leave:

Article 113. Annual Leave

  1. Employees who have worked for a full 12 months for an employer are entitled to annual leave with full pay under labor contracts as follows:

a) 12 working days for employees working under normal conditions;

b) 14 working days for juvenile employees, disabled employees, and those engaged in arduous, toxic, or dangerous jobs;

c) 16 working days for employees engaged in particularly arduous, toxic, or dangerous jobs.

  1. Employees who have not worked for a full 12 months for an employer will have their annual leave days proportionate to the number of months worked.
  1. In cases of termination of employment or job loss, without taking annual leave or not taking full annual leave, the employer shall pay the employee for the remaining days of annual leave.
  1. Employers are responsible for setting the annual leave schedule after consulting with employees and must inform them in advance. Employees can agree with employers to take annual leave in multiple periods, or accumulate and take leave once every three years.

According to the above regulations, employees engaged in particularly arduous, toxic, or dangerous jobs, who work for a full 12 months for an employer, are entitled to 16 days of annual leave.

Additionally, for every 05 years of service with the same employer, the annual leave entitlement of an employee will be increased by 01 day. (As stipulated in Article 114 of the Labor Code 2015).
