On November 22, 2023, the Ministry of Labor, War Invalids and Social Affairs issued Notice 5015/TB-LDTBXH 2023 on Lunar New Year holidays and National Day holidays in 2024 for officials, civil servants and public employees. and workers.

According to this Article, the 2024 Lunar New Year holiday schedule for civil servants and employees is as follows:

- Civil servants and employees will have 07 days off for Lunar New Year 2024. Specifically, from Thursday, February 8, 2024 (on the 29th of the December month in the year of the Cat) to the end of Wednesday, February 14, 2024 (on the 5th of the first month of the year of the Dragon).

- The 2024 Lunar New Year holiday schedule includes 05 days off for Lunar New Year and 02 days off to compensate for weekly holidays according to the 2019 Labor Code.

Can employees take more leaves than the company's Lunar New Year holiday schedule in Vietnam?

Article 115 of the 2019 Labor Code stipulates personal leave, unpaid leave as follows:

Personal leave, unpaid leave

1. An employee is entitled to take a fully paid personal leave in the following circumstances, as long as it is notified to the employer in advance:

a) Marriage: 03 days;

b) Marriage of his/her biological child or adopted child: 01 day;

c) Death of his/her biological or adoptive parent; death of his/her spouse’s biological or adoptive parent; death of spouse, biological or adopted child: 03 days.

2. An employee is entitled to take 01 day of unpaid leave and must inform the employer in the case of the death of his/her grandparent or biological sibling; marriage of his/her parent or natural sibling.

3. The employee may negotiate with his/her employer on taking unpaid leave other than the leave stipulated in Clause 1 and Clause 2 of this Article.

According to this Article, employees are given time off from work and full pay during the New Year and Lunar New Year holidays in Vietnam.

However, if the employee wishes to take additional leave after the end of the Tet holiday period as announced by the company, he or she can negotiate with the company to receive additional leave. In this case, the employee will take these additional leaves without pay in Vietnam.

On the contrary, if the employee and the company cannot reach an agreement, the employee will have to work normally on these additional leaves in Vietnam.

Besides, employees can still use their annual leave to increase the Tet holiday period (according to Article 113 of the 2019 Labor Code).

Can I get a salary advance for the 2024 Lunar New Year holiday in Vietnam?

Article 101 of the 2019 Labor Code stipulates salary advances as follows:

Salary advances

1. An employee may receive an interest-free salary advance in accordance with conditions agreed on by the two parties.

2. The employer must make the advance payment to the employee for the number of days the employee temporarily leaves his/her work in order to perform duties of citizens for a period of 01 week or longer, but the advance shall not exceed 01 month’s salary. The employee must reimburse the advance.

An employee who is conscripted in accordance with the Law on Conscription may not receive salary advance.

3. When taking annual leave, an employee shall receive an advance payment of at least salary for the entitled days of leave.

Thus, employees can agree with the employer to advance their salary before the 2024 Tet holiday and the employer does not charge interest on this amount in Vietnam.

Is it mandatory to give Tet bonuses to employees in Vietnam?

In Article 104 of the 2019 Labor Code, there are regulations on bonuses as follows:

Bonuses

1. A bonus means an amount of money, a piece of property or item that is provided by an employer for his/her employees on the basis of the business performance or the employees’ performance.

2. A bonus regulation shall be decided and publicly announced at the workplace by the employer after consultation with the representative organization of employees (if any).

Thus, Tet bonuses are not mandatory but are based on production and business results and the level of work completion of employees.

Bonus regulations are decided by the employer and announced publicly at the workplace in Vietnam.
