What is Considered a Foreign Expert Working in Vietnam?

Based on the provisions of Clause 3 Article 3 of Decree 152/2020/ND-CP (effective from February 15, 2021), the following applies:

An expert is a foreign worker who falls under one of the following cases:

- Possesses a university degree or higher, or its equivalent, and has at least 3 years of work experience in the field of training suitable for the job position that the foreign worker is expected to work in Vietnam;

- Has at least 5 years of experience and a professional practice certificate suitable for the job position that the foreign worker is expected to work in Vietnam;

- Special cases decided by the Prime Minister of the Government of Vietnam upon the proposal of the Ministry of Labor, Invalids, and Social Affairs.

Thus, the determination of a foreign worker as an expert working in Vietnam will be based on the above provisions.
