+ A certificate of HIV infection from a competent health agency, for cases of HIV infection;

+ A certificate of pregnancy from a competent health agency in case the disabled person is pregnant;

+ Certificate of disability for people with disabilities.

- Step 2: Within 07 working days from the day on which the complete application is received, the civil servant in charge of Labour, War Invalids and Social Affairs is responsible for reviewing the dossier and submitting it to the President of the People's Committee for approval. The commune shall organize the review and decide on the review and approval, and publicly post the results of the review and approval at the headquarters of the commune-level People's Committee within 2 working days, except for information related to HIV/AIDS. If there is a complaint, within 10 working days from the date of receipt of the complaint, the chairperson of the commune-level People's Committee shall organize the review, conclusion and publicity of the complaint contents.

- Step 3: Within 03 working days after the application is approved and there is no complaint, the Chairman of the commune-level People's Committee shall send a written request together with the subject's dossier to the Department of Labor. - Invalids and Social.

- Step 4: Within 07 working days from the date of receiving the subject's dossier and the written request of the chairperson of the commune-level People's Committee, the Division of Labor - Invalids and Social Affairs is responsible for assessing decide and submit to the Chairman of the People's Committee of the district, town or provincial city for decision on the monthly social allowance and monthly care and nurturing funding support for the subject. In case the subject is not eligible for benefits, the Division of Labor - Invalids and Social Affairs shall reply in writing and clearly state the reason.

- Step 5: Within 03 working days from the date of receiving the written submission from the Division of Labor - Invalids and Social Affairs, the Chairman of the district-level People's Committee shall consider and decide the monthly social allowance, support monthly care and nurturing expenses for subjects.

Is it mandatory to attach declaration of the person receiving care for application file for monthly care and nurturing funding in Vietnam?

At section 1.3, subsection 1, Section 1, Part II, administrative procedures for amending and supplementing the field of social protection within the scope of state management functions of the Ministry of Labor, War Invalids and Social Affairs, promulgated together with Decision 292 /QD-LDTBXH in 2023 stipulates the composition of the application as follows:

1.3. Composition, number of records

* Profile composition includes:

- For the application file for monthly social allowance: Declaration of the subject (under Form No. 1a, 1b, 1c, 1d, 1d issued together with Decree No. 20/2021/ND-CP).

- For the application file for monthly care and nurturing funding:

+ Declaration of households with people with disabilities (according to Form No. 2a issued together with Decree No. 20/2021/ND-CP);

+ Declaration for taking care and nurturing social protection subjects (under Form No. 2b issued together with Decree No. 20/2021/ND-CP);

+ Declaration of the subject receiving care and nurture in case the subject is not entitled to monthly social allowance (according to Form No. 03 issued together with Decree No. 20/2021/ND-CP).

* Quantity: 01 set.

Thus, the application file for monthly care and nurturing funding must be attached with the declaration of the person receiving care and nurture in case the person does not receive the monthly social allowance in Vietnam.
