Are foreign employees in Vietnam entitled to days off on Lunar New Year's Eve 2025?
According to Article 112 of the Labor Code 2019 regarding public holidays in Vietnam:
Article 112. Public holidays
1. Employees are entitled to fully paid leave during the following holidays:
a) Gregorian New Year: 1 day (January 1, Gregorian calendar);
b) Lunar New Year: 5 days;
c) Victory Day: 1 day (April 30, Gregorian calendar);
d) International Labor Day: 1 day (May 1, Gregorian calendar);
dd) National Day: 2 days (September 2, Gregorian calendar and 1 adjacent day either before or after);
e) Hung Kings' Commemoration Day: 1 day (March 10, lunar calendar).
2. Foreign employees working in Vietnam are entitled to an additional 1 day off for their traditional New Year and 1 day for their National Day in addition to the holidays stipulated in Clause 1 of this Article.
3. Annually, According to actual conditions, the Prime Minister of the Government of Vietnam specifically decides on the holidays stipulated in Points b and đ of Clause 1 of this Article.
According to the above regulations, foreigners employed in Vietnam are entitled to fully paid leave on the following days:
- Gregorian New Year- Lunar New Year
- Victory Day
- International Labor Day
- National Day
- Hung Kings' Commemoration Day
- Their traditional New Year and 1 day for their National Day
Thus, foreigners working in Vietnam are entitled to fully paid leave during the Lunar New Year 2025.
How many annual leave days are foreigners working under normal conditions in Vietnam entitled to?
According to Article 113 of the Labor Code 2019 regarding annual leave in Vietnam:
Article 113. Annual leave
1. Employees who have worked for 12 months for an employer are entitled to fully paid annual leave as follows:
a) 12 working days for employees performing work under normal conditions;
b) 14 working days for minor employees, disabled employees, employees doing heavy, hazardous, or dangerous work;
c) 16 working days for employees doing special heavy, hazardous, or dangerous work.
2. Employees who have not yet worked for 12 months for an employer are entitled to annual leave proportional to the number of months worked.
3. In cases where an employee resigns or loses their job and has not yet taken or fully utilized their annual leave, the employer must pay salary for the unused leave days.
4. Employers are responsible for setting the annual leave schedule after consulting with employees and must notify the employees in advance. Employees may agree with employers to take annual leave in parts or to accumulate up to 3 years at once.

According to the above regulations, foreign employees working under normal conditions who have worked for 12 months for an employer are entitled to 12 days of annual leave.
Additionally, for every 5 years of service with an employer, the number of annual leave days for employees is increased by 1 day. (Regulation at Article 114 of the Labor Code 2019)
