What are the essential contents of a vocational training contract?
I am drafting a vocational training contract and seek the assistance of an expert for guidance on the necessary contents to include in this contract.According to the provisions of Article 62 of the 2012 Labor Code:
Both parties must sign a vocational training contract in cases where employees are trained to improve their professional skills or retrained domestically or abroad using the employer's funds, including funds provided by partners to the employer.
The vocational training contract must be made in 02 copies, each party retaining 01 copy.
The vocational training contract must contain the following essential contents:
- The vocation to be trained;- Training location and duration;- Training costs;- The duration which the employee commits to work for the employer after being trained;- Responsibility for reimbursement of training costs;- Responsibilities of the employer.
Thus, when drafting a vocational training contract, you need to ensure the 6 essential contents listed above.
Regarding training costs, this section includes expenses with valid vouchers for payment of the instructor, study materials, school, class, machinery, equipment, practice materials, other supporting expenses for the trainee, and salary, social insurance, health insurance paid for the trainee during the training period. In cases where employees are sent for training abroad, the training costs also include travel expenses and living expenses while abroad.
