What are the cases of holding dialogue at the workplace in Vietnam?
According to Clause 1, Article 65 of the Labor Code 2012, dialogue at the workplace in Vietnam must be conducted once every 3 months or at the request of either party.
However, according to Clauses 2 and 3, Article 63 of the Labor Code 2019 (Effective from January 1, 2021), the regulations on organizing dialogues are as follows:
- Dialogue at the workplace shall be held by the employer:
+ at least once a year;
+ whenever requested by one or both party;
+ in any of the events specified in Point a Clause 1 Article 36, Articles 42, 44, 93, 104, 118 and Clause 1 Article 128 of this Labor Code.
- Employers, employees and representative organizations of employees are encouraged to hold dialogues in occasions other than those specified in Clause 2 of this Article.
Thus, shortly, there will be many cases where employers in Vietnam must hold dialogues in the workplace compared to current regulations.
