Pursuant to Article 11 of the Law on Public Employees 2010, the rights of public employees in charge of registration of security interests in professional work in Vietnam are as follows:

- Protected by law in professional activities.

- Entitled to training and fostering to improve political, professional, and vocational qualifications.

- Provided with equipment, devices, and working conditions.

- Supplied with information related to the assigned job or task.

- Entitled to make decisions on professional issues related to the assigned job or task.

- Right to refuse to carry out a job or task that is contrary to the provisions of the law.

- Enjoy other rights related to professional activities as prescribed by law.

What are standards and conditions for consideration for promotion to Class II public employees in charge of registration of security interests in Vietnam?

Pursuant to Article 4 of Circular 11/2024/TT-BTP, the standards and conditions for consideration for promotion from Class III to Class II public employees in charge of registration of security interests in Vietnam are as follows:

Article 4. Standards and conditions for consideration for promotion from Class III to Class II public employees in charge of registration of security interests

1. Holding the title of public employees in charge of registration of security interests Class III - Code No: v.00.01.03 (hereinafter referred to as public employees in charge of registration of security interests Class III) at the time of submitting the application for promotion examination.

2. Meeting the professional capacity and expertise standards for public employees registering a security measure Class II - Code No: V.00.01.02 as prescribed in Clause 2, Article 6 of Circular No. 10/2024/TT-BTP.

3. Having held the title of public employees in charge of registration of security interests Class III for at least 9 years.

In cases where the duration of holding the title of public employees in charge of registration of security interests Class III is less than 9 years but the candidate has held an equivalent title, promotion may be considered if the total time of holding both titles is at least 9 years, with a minimum of 1 year (12 months) holding the title of public employees in charge of registration of security interests Class III.

According to the above provisions, the standards and conditions for promotion of public employees registering a security measure to Class 2 are stipulated as follows:

[1] Holding the title of public employees in charge of registration of security interests Class 3 at the time of submitting the application for promotion examination.

[2] Meeting the professional capacity and expertise standards for public employees registering a security measure Class 2 as follows:

- Thoroughly understanding and correctly implementing the guidelines and policies of the Communist Party and the legal policies of the State on providing public services and administrative procedures in the performance of assigned tasks.

- Possessing the knowledge, expertise, and skills necessary to perform tasks.

- Having the capacity to provide professional guidance and training to perform tasks.

- Possessing capabilities and skills in drafting documents, analyzing, and explaining to perform tasks.

- Having the ability to cooperate with relevant agencies, organizations, and individuals in the performance of tasks.

[3] Having held the title of public employees in charge of registration of security interests Class 3 for at least 9 years.

In cases where the duration of holding the title of public employees in charge of registration of security interests Class 3 is less than 9 years but the candidate has held an equivalent title, promotion may be considered if the total time of holding both titles is at least 9 years, with a minimum of 1 year (12 months) holding the title of public employees in charge of registration of security interests Class 3.

The period of holding the title mentioned above does not include probationary or internship periods.

[4] Having performed at least 1 of the following tasks: Advising, proposing, and commenting on programs, plans, documents, or schemes related to registering a security measure or providing public services at the Registration Center as assigned by the competent authority and having a decision or confirmation of task performance from the competent authority.

What are standards and conditions for consideration for promotion to Class I public employees in charge of registration of security interests in Vietnam?

Pursuant to Article 5 of Circular 11/2024/TT-BTP the standards and conditions for consideration for promotion to Class I public employees in charge of registration of security interests in Vietnam are as follows:

[1] Holding the title of public employees in charge of registration of security interests Class 2 at the time of submitting the application for promotion examination.

[2] Meeting the professional capacity and expertise standards for public employees registering a security measure Class 1 as follows:

- Thoroughly understanding and correctly implementing the guidelines and policies of the Communist Party and the legal policies of the State on providing public services and administrative procedures in the performance of tasks.- Possessing the knowledge, expertise, and skills necessary to perform tasks.- Having the capability to organize, develop content, and perform the following tasks:

+ Leading or being primarily responsible for the development of professional and vocational training guidance content for public employees registering a security measure Classs 2 and 3; guiding the professional and vocational practice of public employees registering a security measure Class 2 or Class 3 as assigned by the competent authority.

+ Leading or being primarily responsible for developing, organizing, and implementing programs, plans, documents, or schemes related to registering a security measure or providing public services in accordance with the functions, tasks, and powers of the Registration Center or as assigned by the competent authority.

- Possessing capabilities and skills in drafting documents, analyzing, and explaining to perform tasks.- Having the ability to cooperate with relevant agencies, organizations, and individuals in the performance of tasks.

[3] Having held the title of public employees in charge of registration of security interests Class 2 for at least 6 years.

In cases where the duration of holding the title of public employees in charge of registration of security interests Class 2 is less than 6 years but the candidate has held an equivalent title, promotion may be considered if the total time of holding both titles is at least 6 years, with a minimum of 1 year (12 months) holding the title of public employees in charge of registration of security interests Class 2.

[4] Having performed at least 1 of the following tasks and having a decision or confirmation of task performance from the competent authority:

- Leading or being primarily responsible for developing, organizing, and implementing programs, plans, documents;- Scheme related to registering a security measure;- Providing public services in accordance with the functions, tasks, and powers of the Registration Center or as assigned by the competent authority.

Note: Circular 11/2024/TT-BTP takes effect in Vietnam from November 8, 2024.
