What are responsibilities of the head of agency directly employing cadres, civil servants and public employees in card management in Vietnam?

Article 7 of Decision 06/2008/QD-BNV stipulates responsibilities of the head of agency directly employing cadres, civil servants and public employees in card management as follows:

1. Directly manage the cards of cadres, civil servants and public employees according to the management authority of their agencies, organizations and units.

2. Verify and carry out procedures for issuing and exchanging cards for cadres, civil servants and public employees for use in performing duties and official duties.

3. Cards of cadres, civil servants and public employees are revoked in the following cases:

a. Lending cards or cards issued in contravention of the law;

b. Termination of work or violation of discipline in the form of forced severance;

c. Change of agency, organization, working unit, position, job title or working position.

4. Agencies, organizations, and card-issuing units are responsible for revoking the card, cutting corners, or punching holes in the card to prevent the card from being used.

What are regulations on responsibilities of cadres, civil servants and public employees in management and use of cards in Vietnam?

Article 8 of Decision 06/2008/QD-BNV stipulates responsibilities of cadres, civil servants and public employees in the management and use of cards as follows:

1. Cadres, civil servants and public employees are responsible for managing and using cards strictly according to the provisions of this Decision. Absolutely do not lend the card in any form.

2. Cadres, civil servants and public employees who lose or damage the card must report and explain to the agency, organization or unit competent to manage the card; At the same time, request to be reissued or replaced with a new card.

3. Cadres, civil servants and public employees who are transferred, rotated or seconded to other agencies, organizations or units must return their cards to the old agencies, organizations or units; At the same time, request new agencies, organizations and units to issue cards for use.

4. If cadres, civil servants or public employees change their job title or working position, they shall request the issuing agency, organization or unit to change a new card.

5. Retired cadres, civil servants and public employees may keep their cards after the card-managing agencies, organizations or units have cut corners or punched holes on the cards.

What is handling of violations and organization of implementation of the regulations on card models and management and use of cards for cadres, civil servants and public employees in Vietnam?

In Article 9, Decision 06/2008/QD-BNV regulates handling of violations regarding the regulation of card models and the management and use of cards for cadres, civil servants and public employees as follows:

Cadres, civil servants and public employees who have been issued cards but do not manage and use the cards in accordance with the provisions of Article 8 of this Decision, depending on the nature and severity of the violation, will be subject to disciplinary action according to regulations.

Article 10 of Decision 06/2008/QD-BNV stipulates the organization and implementation of card models and the management and use of cards for cadres, civil servants and public employees as follows:

1. Responsibilities of the Ministry of Home Affairs:

a. Instructions on card making and issuance of cards for cadres, civil servants and public employees;

b. Regulation and issuance of card numbers for cadres, civil servants and public employees nationwide;

c. Inspect and inspect the management and use of cards for officials, civil servants and public employees of ministries, branches and People's Committees of provinces and centrally run cities.

2. Responsibilities of ministries, ministerial-level agencies, Government agencies, and People's Committees of provinces and centrally run cities:

a. Organize card making and issue cards to officials, civil servants and public employees under management authority according to the form prescribed in this Decision. For newly recruited or accepted cadres, civil servants and public employees, the card issuance time must not exceed 30 days from the date that cadre, civil servant or public employee has a decision to recruit or receive;

b. Inspect and urge the implementation of the badge-wearing regime for cadres, civil servants and public employees under their management authority.

3. Take responsibilities of the Department (or Committee) of Personnel Organization of Ministries and Central branches and the Department of Home Affairs of provinces and centrally-run cities in advising and assisting Ministers, Heads of ministerial-level agencies, and Heads of State Government agencies and Chairman of the People's Committees of provinces and centrally run cities organize and implement regulations on the regime of wearing badges for cadres, civil servants and public employees within the scope of Ministries, branches and localities. Specific management methods are as follows:

a. Organize card making and issuance of cards to cadres, civil servants, and public employees in administrative agencies, public service units of the State and commune-level cadres and civil servants;

b. Guide, check and inspect the management and use of cards for cadres, civil servants and public employees under the management authority of ministries, branches and People's Committees of provinces and centrally run cities.

c. Summarize and report to the Minister, the Head of the ministerial-level agency, the Head of the Government-attached agency or the President of the People's Committee of the province or city directly under the Central Government on the implementation of regulations on card management and use for cadres and civil servants. At the same time, send it to the Ministry of Home Affairs for synthesis and reporting to the Prime Minister.
