Pursuant to Article 1 of Decision 8108/QĐ-TLĐ in 2023 stipulating as follows:
The Vietnamese General Confederation of Labor (VGCL) regulates the use of union fees for different levels of unions as follows:
- Grassroots-level trade unions are allocated 70% of the total amount of union fees collected.
- Trade unions at higher levels are allocated 30% of the total amount of union fees collected.
Therefore, the use of union fees is regulated by the VGCL as follows:
- Grassroots-level trade unions are allocated 70% of the total amount of union fees collected.
- Trade unions at higher levels are allocated 30% of the total amount of union fees collected.
Note: Decision 8108/QĐ-TLĐ in 2023 takes effect from the 2023 fiscal year.

Who shall pay trade union fee in Vietnam?
Pursuant to Article 23 of the Regulation on management of the trade union budget and assets, collection and distribution of revenues, rewards and penalties related to trade union revenues and expenditures issued together with the Decision 1908/QĐ-TLĐ in 2016 stipulating subjects, rate of payment and salary used as the basic for payment of the trade union fee as follows:

1. With regard to the trade unionists of regulatory agencies; political organizations, socio-political organizations, socio-political and professional organizations, social organizations, socio-professional organizations; units of the people’s armed forces and trade unionists of public service providers that are paid according to payroll and salary scale prescribed by the State's regulations: The monthly rate of payment of trade union fee shall be 1 % of salary that is used as a basis for social insurance payment according to regulations of Law on Social Insurance.
The salary that is used as the basis for social insurance payment is the salary paid according to quality and position, salary on the labor contract or working contract and position allowances and seniority allowances. If salaries used as the basic for social insurance payment changes, those used as the basic for the payment of trade union fee will also change according to regulations of law on social insurance.
2. With regard to the trade unionists of state-owned enterprises (including the trade unionists of joint-stock company whose control stocks are held by the State): the monthly rate of payment shall be 1% of real salary (the salary minus payment for social insurance, health insurance, unemployment insurance and personal income tax of trade unionists) but not exceed 10% of statutory pay rate prescribed by the State’s regulations.

Therefore, the object and amount of union fees are as follows:
(1) The monthly union fees amount is equal to 1% of the salary used as the basis for paying social insurance for members of the following trade unions:
- Grassroots trade unions in government agencies
- Political organizations, political-social organizations, political-social-professional organizations, social organizations, and social-professional organizations;
- Units belonging to the People's Armed Forces;
- Units of public service that receive salaries according to the salary tables and grades prescribed by the State.
(2) The monthly union fees amount is equal to 1% of the actual salary, but the maximum is only 10% of the minimum wage, for members of grassroots trade unions in state-owned enterprises.
(3) The monthly union fees amount is equal to 1% of the salary used as the basis for paying social insurance, but the maximum monthly union dues amount is only 10% of the minimum wage, for members of the following trade unions:
- Non-state-owned enterprises;
- Non-public non-profit units that receive salaries not according to the salary tables and grades prescribed by the State;
- Cooperative unions;
- Foreign organizations, international organizations operating in Vietnam;
- The operating office of the foreign side in the business cooperation contract in Vietnam;
- Union members working abroad:
(4) The union fees amount is determined but the minimum amount is 1% of the minimum wage for:
- Members of labor unions, grassroots trade unions in enterprises that are difficult to determine the salary basis for paying union dues;
- Union members who are not subject to social insurance.
What are methods for payment of the trade union fee in Vietnam?
Pursuant to Clause 1 Article 24 of the Regulation on management of the trade union budget and assets, collection and distribution of revenues, rewards and penalties related to trade union revenues and expenditures issued together with the Decision 1908/QĐ-TLĐ in 2016 stipulating methods for payment of the trade union fee in Vietnam as follows:
- Pay directly to the trade union committee, trade union section, member grassroots trade union, grassroots trade union, labor union every month.
- Deduct from salary every month after obtaining the consent of the union member.
