What are professional qualifications standards for appointment of forensic experts and forensic psychiatric experts in Vietnam?

In Clause 1 Article 3 of Circular 11/2022/TT-BYT (effective December 15, 2022) has regulations on determining professional qualifications standards for the appointment of forensic medical experts and forensic psychiatric medical experts as follows:

Vietnamese citizens permanently residing in Vietnam who meet the general standards specified in Clause 1, Article 7 of the Law on Judicial Expertise, do not fall into the cases specified in Clause 2, Article 7 of the Law on Judicial Expertise, and meet the specific standards following possible:

1. Professional qualifications

Have a university degree or higher in one of the training majors specified in Circular No. 09/2022/TT-BGDDT dated June 6, 2022 of the Ministry of Education and Training stipulating the Statistical List of training majors of higher education appropriate to each area of ​​expertise, specifically:

a) For the person proposed to appoint a forensic expert:

Medical training majors (except preventive medicine training majors) for people performing forensic expertises.

Pharmacology and chemistry training groups for people performing forensic expertise in the field of toxicology.

The group of majors trains biology and applied biology for people performing forensic expertise in the biomedical field.

The training group is suitable for other forensic expertise fields.

b) For the person proposed to be appointed as a forensic mental health expert: is a doctor in the general medical training field who has been granted a Certificate or Certificate of specialized training in psychiatry for 06 months or more in Vietnam. training establishments with specialized training functions in psychiatry; or a doctor who has been granted a postgraduate training degree in psychiatry (Specialist I, Specialist II, Resident Doctor, Master, Doctor).

In Clause 2 Article 3 of Circular 11/2022/TT-BYT (effective December 15, 2022) has regulations expertise professional standards for the appointment of forensic experts and forensic mental health experts are as follows:

2. Expertise in appraisal

a) For people proposed to be appointed as forensic experts: must have a certificate of training in forensic expertise skills issued by the National Institute of Forensic Medicine.

b) For people proposed to be appointed as forensic mental health experts: must have a certificate of training in forensic mental health expertise from the Central Institute of Forensic Psychiatry or the Bien Hoa Central Institute of Forensic Psychiatry. 

What are standards for actual professional practice time for the appointment of forensic experts and forensic psychiatric experts in Vietnam?

In Clause 3 Article 3 of Circular 11/2022/TT-BYT (effective December 15, 2022) has provisions on standards for actual professional practice time for appointment of forensic experts and forensic psychiatric experts are as follows:

3. Actual time of professional activities

a) For the person proposed to be appointed as a forensic expert: must have actual professional experience in the field trained as prescribed in Point a, Clause 1 of this Article for 5 years or more. In case you have directly assisted in appraisal activities at a forensic appraisal organization, the period of practical professional activity in the trained field is 03 years or more.

b) For people proposed to be appointed as forensic mental health experts: must have actual time working professionally in the trained field as prescribed in Point b, Clause 1 of this Article at a medical expertise facility for 5 years or more. In case you have directly assisted in expertise activities at a forensic psychiatric expertise organization, the period of practical professional activity in the trained field is 3 years or more.
