Pursuant to Article 112 of the Labor Code 2019 stipulating public holiday:
Article 112. Public holiday
- Employees are entitled to a day off work with full pay on the following holidays:
a) New Year's Day: 1 day (January 1 of the Gregorian calendar);
b) Lunar New Year: 5 days;
c) Victory Day: 1 day (April 30 of the Gregorian calendar);
d) International Labor Day: 1 day (May 1 of the Gregorian calendar);
dd) National Day: 2 days (September 2 of the Gregorian calendar and 1 day either before or after);
e) Hung Kings' Commemoration Day: 1 day (March 10 of the lunar calendar).
- Employees who are foreigners working in Vietnam, in addition to the holidays specified in Clause 1 of this Article, are entitled to 1 additional traditional Tet holiday of their homeland and 1 National Day of their country.
- Annually, based on actual conditions, the Prime Minister of the Government of Vietnam decides specific days off as stipulated at point b and point dd, clause 1 of this Article.

What is the salary for working on the the Gregorian New Year Holiday in 2025?
Pursuant to Article 98 of the Labor Code 2019 regarding overtime and night work pay:
Article 98. Overtime work pay, night work pay
- Employees who work overtime are paid according to the wage unit price or the actual salary of the current work as follows:
a) On weekdays, at least 150%;
b) On weekly days off, at least 200%;
c) On public holidays, Tet, days off with pay, at least 300% not including the salary of those holidays for employees who get paid by the day.
- Employees who work at night are paid an additional at least 30% of the wage unit price or actual salary of the normal working day.
- Employees who work overtime at night, besides being paid according to Clause 1 and Clause 2 of this Article, are also paid an additional 20% of the wage unit price or salary for the daytime work of the normal working day, or weekly days off or public holidays, Tet.

In which cases are employees in Vietnam not allowed to refuse overtime?
Pursuant to Article 108 of the Labor Code 2019, the employer has the right to request employees to work overtime on any day without limitation on overtime hours and employees may not refuse in the following cases:
- To execute mobilization orders, ensure tasks for national defense and security as prescribed by law.
- To perform tasks to protect human life, property of agencies, organizations, individuals in the prevention and remedy of natural disasters, fires, dangerous epidemics, and catastrophes, except in cases where there is a risk affecting the life and health of employees according to the provisions of law on labor safety and hygiene.
