What is the maximum days off for employees on the National Day (the 2nd of September) in 2023 in Vietnam?
Pursuant to Article 112 of the Labor Code in 2019 stipulating public holidays in Vietnam as follows:
Public holidays
1. Employees shall be entitled to fully paid days off on the following public holidays:
a) Gregorian Calendar New Year Holiday: 01 day (the 1st of January of the Gregorian calendar);
b) Lunar New Year Holidays: 05 days;
c) Victory Day: 01 day (the 30th of April of the Gregorian calendar);
d) International Labor Day: 01 day (the 1st of May of the Gregorian calendar);
dd) National Day: 02 days (the 2nd of September of the Gregorian calendar and the previous or next day);
e) Hung Kings Commemoration Day: 01 day (the 10th of the third month of the Lunar calendar).
2. Foreign employees in Vietnam are entitled to 01 traditional public holiday and 01 National Day of their country, in addition to the public holidays stipulated in Clause 1 of this Article.
3. The Prime Minister shall decide the specific public holidays mentioned in Point b and Point dd Clause 1 of this Article on an annual basis.
Pursuant to Article 111 of the Labor Code in 2019 stipulating weekly breaks as follows:
Weekly breaks
1. Each week an employee is entitled to a break of at least 24 consecutive hours. Where it is impossible for the employee to have a weekly day off due to the work cycle, the employer has the responsibility to ensure that on average the employee has at least 04 days off per month.
2. The employer has the right to determine and schedule the weekly breaks either on Sunday or for another fixed day in a week, which must be recorded in the internal labor regulations.
3. In case a public holiday falls on an employee’s weekly break coincide with a public holiday as prescribed in Clause 1 Article 112 of this Labor Code, he/she will have compensatory time-off on the next working days.
As regulations above, depending on the weekly breaks, employees shall be entitled to fully paid days off on the National Day (the 2nd of September) as follows:
Case 1: Employees is entitled to 02 days of weekly breaks
The National Day (the 2nd of September) will be off for 04 consecutive days including: 02 days on weekends, 01 compensatory holiday and 01 the previous or next day.
Case 2: Employees is entitled to 01 day of weekly breaks
The National Day (the 2nd of September) will be off for 03 consecutive days including: 01 day of the weekends, 01 compensatory holiday and 01 the previous or next day.
What are days off for students on the National Day (the 2nd of September) in 2023 in Vietnam?
Similar to employees, the holiday schedule for students will depend on the school day of the week. Specifically, the National Day (the 2nd of September) holiday schedule for students is regulated as follows:
Case 1: The training institution teaches and learns 06 days/week: students will have a holiday on the National Day (the 2nd of September), which is 03 consecutive days.
Case 2: Training institution teaches and learns 05 days/week: students will have a holiday on the National Day (the 2nd of September), which is 04 consecutive days.
Note: Students need to pay notice on the holiday schedule according to the school's announcement.
What are days off for civil servants and public employees on the National Day (the 2nd of September) in 2023 in Vietnam?
Pursuant to Official Letter 8056/VPCP-KGVX in 2022, the Deputy Prime Minister commented on the holiday schedule as follows:
1. Agree with the proposal in the above document of the Ministry of Labor - Invalids and Social Affairs on the Lunar New Year holiday from January 20, 2023 to the end of January 26, 2023 and National Day holiday from September 1, 2023 to the end of September 4, 2023.
Agencies and units implementing the above holiday schedule must arrange reasonable work arrangements to handle continuous work, ensuring good service to the organization and the people.
2. Other weekly holidays, public holidays and New Year's holidays shall comply with the provisions of the Labor Code.
3. Authorize the Minister of Labor, War Invalids and Social Affairs to announce the Lunar New Year holiday and National Day holiday in 2023.
Thus, civil servants will be off for the National Day Holiday on September 2, 2023, starting from Friday (September 1, 2023) to the end of Monday (September 4, 2023).
