Who is a trade union official?
According to Clause 5, Article 4 of the Labor Union Law 2024, a trade union official is a Vietnamese citizen who is elected, recruited, appointed, or assigned to perform the tasks of a union organization. Trade union officials include:
- Full-time trade union officials who are elected, recruited, appointed, or assigned to regularly handle work within the union organization.
- Part-time trade union officials who are elected by union levels or designated by the competent authority of the union to hold a position from vice-head of the union team upwards to concurrently perform union organization tasks.

What are additional prohibited acts for trade union officials in Vietnam from July 1, 2025?
Based on Article 10 of the Labor Union Law 2024, the following acts are prohibited:
Article 10. Prohibited Acts
- Obstructing or causing difficulties in exercising union rights.
- Discrimination against employees, trade union officials due to the establishment, joining, or activities of the union, including the following actions:
a) Forcing participation, non-participation, or exit from the Vietnam General Confederation of Labor to be recruited, conclude, or extend labor contracts or working contracts;
b) Dismissing, disciplining, unilaterally terminating labor contracts or working contracts; not continuing to conclude or extend labor contracts or working contracts; transferring employees to other jobs;
c) Wage, bonus, welfare discrimination; working hours, other rights and obligations discrimination in employment;
d) Gender, ethnicity, religion, belief discrimination, and other discrimination in employment;

The Labor Union Law 2024 has supplemented many prohibited acts in trade union activities compared to the Labor Union Law 2012, including:

- Receiving aid, sponsorship, or technical support contrary to the provisions of the law.
- Not paying union fees; delayed payment of union fees; incorrect payment rates of union fees; incomplete payment for those required to pay; improper management and use of union funds.
- Providing false information, inciting, distorting, defaming the organization and activities of the union.
- Failing to ensure operating conditions for unions and trade union officials according to legal regulations.

- Promising or providing material or immaterial benefits so employees, trade union officials do not participate in union activities, resign from union positions, or act against the union.
- Influencing, obstructing, causing work-related difficulties to weaken union activities.
- Other acts as prescribed by law.
Do trade union members have the right to propose disciplinary action against trade union officials in Vietnam?
According to Article 21 of the Labor Union Law 2024, the rights of union members are specified as follows:
Article 21. Rights of Union Members
- Request the union to represent and protect their legal and legitimate rights and interests when violated.
- Be informed, discuss, propose, and vote on the work of the union.
- Be educated and informed about the policies and guidelines of the Communist Party, State policies and laws related to the union, employees, and Union regulations.
- Stand for election, nominate, and vote for the leadership of the union in accordance with this Law and the Charter of the Vietnam General Confederation of Labor.
- Question union leaders at all levels, propose disciplinary action against trade union officials with violations according to the Charter of the Vietnam General Confederation of Labor.
