Vocational Training and Apprenticeship for Employment with Employers from 2021
Apprenticeship and on-the-job training to work for the employer?
Article 61 of the Labor Code of 2019 stipulates:
Apprenticeship to work for the employer refers to the employer recruiting individuals for vocational training at the workplace. The duration of the apprenticeship follows the training program for each level as regulated by the Law on Vocational Education.
On-the-job training to work for the employer refers to the employer recruiting individuals to guide them in practicing the job, training them according to the job position at the workplace. The duration of on-the-job training is not to exceed 03 months.
Employers recruiting individuals for apprenticeship or on-the-job training for their own work are not required to register for vocational education activities; they are not allowed to collect tuition fees and must sign a training contract in accordance with the Law on Vocational Education.
Apprentices and trainees must be at least 14 years old and have sufficient health suitable for the requirements of the apprenticeship or on-the-job training. Apprentices and trainees in the list of heavy, hazardous, dangerous occupations or particularly heavy, hazardous, dangerous jobs issued by the Minister of Labor - Invalids and Social Affairs must be at least 18 years old, except in the fields of arts, sports, and physical training.
During the period of apprenticeship or on-the-job training, if apprentices or trainees directly engage in work or participate in labor, the employer must pay them a salary as agreed upon by both parties.
Upon the completion of the apprenticeship or on-the-job training period, both parties must enter into a labor contract when meeting the conditions as prescribed by this Code.
At what age can one receive apprenticeship or on-the-job training to work for an employer?
Based on Clause 4 of Article 61 of the Labor Code of 2019, it is stipulated:
Apprentices and trainees must be at least 14 years old and must have sufficient health appropriate to the requirements of the apprenticeship or on-the-job training. Apprentices and trainees in the list of heavy, hazardous, dangerous occupations or particularly heavy, hazardous, dangerous jobs issued by the Minister of Labor - Invalids and Social Affairs must be at least 18 years old, except in the fields of arts, sports, and physical training.
Therefore, apprentices and trainees must be at least 14 years old and have sufficient health suitable for the requirements of the apprenticeship or on-the-job training. For those in the list of heavy, hazardous, dangerous, or particularly heavy, hazardous, dangerous jobs issued by the Minister of Labor - Invalids and Social Affairs, they must be at least 18 years old according to the above regulations.
