December 2 every year is designated as the International Day for the Abolition of Slavery, according to a decision by the United Nations General Assembly (UN).

The first observance was in 1986. The day to abolish slavery is held annually on December 2. The goal of this day is to end all forms of slavery, eradicate human trafficking and prostitution. At the same time, the International Day for the Abolition of Slavery serves as an occasion to support those affected in returning to normal lives.

Therefore, December 2 is the International Day for the Abolition of Slavery. According to the perpetual calendar, December 2, 2024, corresponds to November 2, 2024, in the lunar calendar.

Is it permissible to require employees in Vietnam to work overtime?

Based on Article 107 of the Labor Code 2019 regulating overtime work:

Article 107. Overtime work

  1. Overtime work is the period worked outside the normal working hours as regulated by law, collective labor agreement, or labor regulations.
  1. Employers may require employees to work overtime when the following conditions are met:

a) The employee agrees;

b) Ensuring that the employee's overtime does not exceed 50% of the normal working hours in one day; in case normal working hours are applied weekly, the total normal and overtime working hours must not exceed 12 hours in one day; not more than 40 hours in one month;

c) Ensuring that the employee's overtime does not exceed 200 hours in one year, except as regulated in clause 3 of this Article.

Based on Article 108 of the Labor Code 2019 regulating special cases of overtime work:

Article 108. Overtime work in special cases

Employers have the right to request employees to work overtime on any day without the restriction on overtime hours as stipulated in Article 107 of this Code, and employees are not allowed to refuse in the following cases:

  1. Implementation of mobilization orders, ensuring defense and security duties as stipulated by law;
  1. Performing tasks to protect human life, and property of agencies, organizations, individuals in preventing, overcoming consequences of natural disasters, fires, dangerous epidemics, and disasters, except in cases that may endanger the life or health of employees as stipulated by law on occupational safety and hygiene.

Under these regulations, employers can only make employees work overtime with their consent. Therefore, employers are not allowed to require employees to work overtime, except in the following cases:

- Implementation of mobilization orders, ensuring defense and security duties as stipulated by law

- Performing tasks to protect human life, and property of agencies, organizations, individuals in preventing, overcoming consequences of natural disasters, fires, dangerous epidemics, and disasters, except in cases that may endanger the life or health of employees as stipulated by law on occupational safety and hygiene

What is the normal working time in a week according to the law in Vietnam?

Based on Article 105 of the Labor Code 2019 regulating normal working hours:

Article 105. Normal working hours

  1. Normal working hours must not exceed 8 hours in one day and 48 hours in one week.
  1. Employers have the right to set working hours on a daily or weekly basis but must inform employees; in the case of weekly working hours, normal working hours must not exceed 10 hours in one day and not exceed 48 hours in one week.

The Government encourages employers to implement a 40-hour workweek for employees.

  1. Employers are responsible for ensuring the limits on working time in contact with hazardous factors, ensuring compliance with national technical standards and related legislation.

According to these regulations, the normal working time for employees is not to exceed 48 hours in one week.
