Title: Working on Holidays: Is Compensatory Time Off Allowed?
According to the provisions of Clause 3, Article 111 of the Labor Code 2019, the weekly rest days are regulated as follows:
If the weekly rest day coincides with the public holidays and Tet holidays prescribed in Clause 1, Article 112 of this Code (including National Day), the employee is entitled to take compensatory rest on the next working day.
Thus, the employee will be entitled to compensatory rest on the working day of the following week when the weekly rest day coincides with a public holiday. This means that there is no provision for compensatory rest for employees who work on a public holiday. Employees who work on a public holiday will only be paid overtime wages without compensatory rest on another day. However, in practice, you can negotiate with the employer regarding compensatory rest as mentioned above.
