The duration of maternity leave for female prisoners giving birth in prison
In Clause 4, Article 32 of the 2019 Law on Execution of Criminal Judgments, it is stipulated that:
- Inmates who are ill and not physically fit to work, as confirmed by the prison's medical staff;
- Inmates undergoing treatment at a medical facility;
- Inmates who have children under 36 months old living with their mothers in prison and who are ill, as confirmed by the prison's medical staff;
- Pregnant female inmates are entitled to maternity leave before and after childbirth as stipulated by labor law. And in Clause 1, Article 139 of the 2019 Labor Code, it is stipulated that:
- Female employees are entitled to maternity leave before and after childbirth for a total of 6 months; the period of leave before childbirth must not exceed 2 months.
=> Therefore, according to the aforementioned provision, female inmates who give birth in prison will be entitled to 6 months of leave both before and after childbirth.
