When is the deadline for submitting the labor usage report for the first 06 months of 2024?
Based on Clause 2, Article 4 of Decree 145/2020/ND-CP as amended and supplemented by Clause 1, Article 73 of Decree 35/2022/ND-CP and Clause 1, Article 49 of Decree 10/2024/ND-CP regulating labor usage reports:

The declaration of labor usage, periodic reporting of changes in labor outlined in Clause 2, Article 12 of the Labor Code is regulated as follows:

2. Periodically every 06 months (before June 05) and annually (before December 05), the employer must report labor changes to the Department of Labor, War Invalids, and Social Affairs through the National Public Service Portal using Form 01/PLI of Appendix I issued together with this Decree and notify the district-level social insurance agency where the headquarters, branch, or representative office is located. If the employer is unable to report labor changes through the National Public Service Portal, they must submit a paper report using Form 01/PLI of Appendix I issued together with this Decree to the Department of Labor, War Invalids, and Social Affairs and notify the district-level social insurance agency where the headquarters, branch, or representative office is located. For workers in industrial and economic zones, the employer must report labor changes to the Department of Labor, War Invalids, and Social Affairs, the district-level social insurance agency where the headquarters, branch, or representative office is located, and the management board of the industrial or economic zone for monitoring.
The Department of Labor, War Invalids, and Social Affairs is responsible for consolidating labor changes in the case the employer submits a paper report to fully update the information in accordance with Form 02/PLI of Appendix I issued together with this Decree.

Instructions on reporting labor usage on the National Public Service Portal
The labor usage report on the National Public Service Portal is carried out as follows:
Step 1: Access the National Public Service Portal via the link https://dichvucong.gov.vn/p/home/dvc-trang-chu.html
Step 2: Log in to the National Public Service Portal using the registered account. Typically, for enterprises, this means using a USB Token digital signature device to log in.
If the enterprise does not have an account, it must register for one.
Step 3: After logging in, select the function "Online Public Service". Then search for the keyword "Labor Usage Report".
Step 4: Select "Submit Online Filing".
Step 5: Fill in all information as required by the report form. Then select the receiving agency (Department of Labor, War Invalids, and Social Affairs or the Division of Labor, War Invalids, and Social Affairs).
Step 6: Choose the form of submission (Directly or via Postal Service) and the payment method (Bank Transfer or Online Payment).
Step 7: Submit the dossier. When the screen shows the table "Congratulations to the enterprise for successfully updating the information about the agency receiving the labor report", click the "Exit" button to complete the procedure.
Thereafter, the enterprise can track the processing status of the dossier on the National Public Service Portal using the previously received dossier code.
What is the fine for not reporting labor usage?
According to Article 8 of Decree 12/2022/ND-CP, the handling of violations of an enterprise's failure to report labor usage, depending on each case, is specified as follows:
- Fines ranging from VND 1,000,000 to VND 3,000,000 for employers who fail to declare labor usage as required;
- Fines ranging from VND 5,000,000 to VND 10,000,000 for employers who fail to report labor changes as required;
Note: The fine levels for these violations are for individuals. The fine levels for organizations are twice the fines for individuals (according to Clause 1, Article 6 of Decree 12/2022/ND-CP).
