Support for Relatives of Employees Who Died or Went Missing While Working Abroad
Support Level for Relatives of Deceased or Missing Workers
Pursuant to Clause 1, Article 14 of Decision 40/2021/QD-TTg (effective from February 21, 2022), the support level for relatives of workers who have died or gone missing while working abroad is 40,000,000 VND per case.
Dossier for Supporting Relatives of Deceased or Missing Workers
Relatives of the worker (father, mother, spouse, child, sibling) or a person authorized by the worker's relatives or a legal representative of the worker's relatives must submit a support request form (Form according to Appendix I issued with this Decision) along with a set of documents proving the case in one of the following forms: online, in-person, by mail, or through enterprises, organizations, or individuals who sent the worker to the Fund Management Agency. The dossier includes:
- A copy of the death certificate of the worker or a document from a competent Vietnamese authority declaring the worker dead or missing during the period of working abroad under a contract;- Documents proving the relationship with the worker;- Authorization document (clearly stating the authorization content) or documents proving legal representation rights as defined in cases where the person is authorized by the worker's relatives or the legal representative of the worker's relatives submits the dossier.
In cases where the dossier is submitted through enterprises, organizations, or individuals who sent the worker, the unit or individual must create a list of supported workers along with the worker's dossier and send it to the Fund Management Agency (Form according to Appendix II issued with this Decision).
Procedure for Receiving Support for Relatives of Deceased or Missing Workers
Based on Clause 3 of this Article, within 15 working days from the date of receiving the complete dossier as prescribed, the Fund Management Agency shall review, compare the dossier, and provide support to the worker's relatives. In cases where support is not provided, a written explanation with reasons must be given.
