Sending Wage Scales at the Parent Company: Are They Dependent on the Personnel of the Subsidiary Company?

Your company is a parent company with 2 subsidiaries. When registering the salary scale, I was informed that if there are fewer than 10 employees, the submission of the salary scale is exempted. Therefore, according to your company's model, are the 10 employees here considered for all 3 companies combined, or is it required that each company individually has more than 10 employees?

According to Clause 1, Article 1 of Decree 121/2018/ND-CP, enterprises employing fewer than 10 workers are exempt from the procedure of sending salary scales, payrolls, and labor norms to the district-level state labor management agency where the enterprise's production and business facilities are located.

As the parent company and subsidiary are legally independent entities from each other, personnel here must be accounted for separately for each company.
