Rewards for Tet in 2021 May Be in Kind?

Question: Can the 2021 Lunar New Year bonus be in the form of goods? I read on some news sites that it is possible. Please clarify this issue.Answer:Under the provisions of the Vietnamese labor law, the Lunar New Year bonus (also known as the Tet bonus) is not strictly required to be in cash. Employers have the discretion to provide the Tet bonus in various forms, including goods, vouchers, or other forms as agreed upon with the employees. This allows for flexibility in rewarding employees, taking into account the company's specific circumstances and agreements made with its workforce.

Article 104 of the 2019 Labor Code (Effective from January 1, 2021) stipulates as follows:

Bonuses are monetary amounts, assets, or other forms awarded by the employer to employees based on production and business results and the level of job performance of the employees.

The bonus policy is determined by the employer and publicly announced at the workplace after consulting with the employee representative organization at the establishment, in the case where there is an employee representative organization at the establishment.

Thus, from the above regulation, it can be easily concluded that this year's Tet bonus does not necessarily have to be in cash. Therefore, enterprises may apply rewards in kind.
