Required Compensation from Employees for Disclosing Company Secrets?
Based on the provisions stipulated in Clause 2, Article 21 of the Labor Code 2019:
When an employee works in a role directly related to business secrets, technological secrets as prescribed by law, the employer has the right to agree in writing with the employee on the content and duration of protecting business secrets, protecting technological secrets, the employee's benefits, and compensation in case of violation.
According to this provision, if the employee performs work directly related to the business and technological secrets of the company, the company is entitled to negotiate with the employee on the issue of compensation for damages in the event of a breach.
However, this provision and related documents do not specify a limit on the amount of compensation, which will be mutually agreed upon by the company and the employee.
