Regulations on Menstrual Leave for Female Employees
According to Clause 3 Article 80 of Decree 145/2020/ND-CP (Effective from February 1, 2021) prescribing menstrual leave for female employees as follows:
- Female employees are entitled to a 30-minute break each day during their menstrual period, counted as working hours and still receiving full salary according to the labor contract. The number of days with menstrual leave shall be mutually agreed upon by the two parties in accordance with the actual conditions at the workplace and the needs of the female employee, but at least 3 working days in a month; the specific break time each month shall be notified by the employee to the employer;
- In the case that the female employee requests more flexible breaks than stipulated in point a of this clause, the two parties shall agree to arrange appropriate breaks according to the actual conditions at the workplace and the needs of the female employee;
- In the case that the female employee does not need to take a break and is agreed by the employer to continue working, in addition to the salary prescribed in point a of this clause, the employee shall be paid additional salary for the work performed during the time off and this working time shall not be counted as overtime.
