What are regulations on registration of accounts on the Database of Vietnamese guest workers?
Pursuant to Article 6 of the Circular 20/2021/TT-BLĐTBXH (takes effect from 01/02/2022) stipulating regulations on registration of accounts on the Database of Vietnamese guest workers as follows:
1. Agencies and units that are granted accounts to access the database system include:
a) Department of Overseas Labor, Ministry of Labor, War Invalids and Social Affairs;
b) The specialized labor agency under the People's Committee of the province;
c) Overseas Vietnamese representative missions.
2. Enterprises; non-business units; Organizations and individuals investing abroad and Vietnamese citizens entering into labor contracts after leaving the country register an account on the database system at http://molisa.gov.vn
3. The account has been granted in accordance with the provisions of Circular No. 35/2017/TT-BLDTBXH dated December 29, 2017 regulating the management, operation and exploitation of the Database of Vietnamese guest workers (hereinafter referred to as Circular No. 35/2017/TT-BLDTBXH) may continue to be used and managed in accordance with this Circular.
What are regulations on issuance of License to operate the service of Vietnamese guest workers via the Database of Vietnamese guest workers?
Pursuant to Article 7 of the Circular 20/2021/TT-BLĐTBXH (takes effect from 01/02/2022) stipulating regulations on issuance of License to operate the service of Vietnamese guest workers via the Database of Vietnamese guest workers as follows:
1. An enterprise applying for a License under Article 12 of the Law on Vietnamese Guest workers shall operate as follows:
a) Log in to your account, access the "License issue" section and fill in the information according to the application form for a license to operate the service of Vietnamese guest workers;
b) Upload documents as prescribed to the database system;
c) Digitally sign and submit the application online.
2. Within 20 days from the date of receipt of valid dossiers on the database system, the Ministry of Labor, War Invalids and Social Affairs shall issue a license to the enterprise, the original license shall be paid directly at the ministry via one-way portal or by postal service; In case of refusal to grant a License, a written reply must be given clearly stating the reason. The processing status of the records is displayed on the Database System.
