Procedure for Revocation of Expired Work Permits
Pursuant to the provisions of Clause 1, Clause 3, Article 21 of Decree 152/2020/ND-CP (effective from February 15, 2021) and Clause 1, Article 156 of the Labor Code 2019, the procedures for revoking a work permit upon expiration are as follows:
- Within 15 days from the date the work permit expires, the employer must retrieve the work permit from the foreign employee to submit it to the Ministry of Labor, Invalids and Social Affairs or the Department of Labor, Invalids and Social Affairs that issued the work permit, along with a document stating the reason for the revocation in case the permit falls under the revocation category but cannot be retrieved.
- Within 05 working days from the date of receiving the revoked work permit, the Ministry of Labor, Invalids and Social Affairs or the Department of Labor, Invalids and Social Affairs shall issue a document confirming the revocation of the work permit to the employer.
