Procedure for Extending the Tenure of Leadership and Management Positions Until Retirement Age as Prescribed in Article 53, Decree 138/2020/ND-CP. Specifically, as follows:
- No later than 90 days before the end of the appointment term, the competent authority must issue a notice to undertake the consideration of extending the tenure of leadership and management positions until the retirement age for the official.
- The civil servant shall prepare a self-assessment report, evaluating the performance of their responsibilities and duties during their tenure, and submit it to the competent authority for extending the tenure of the leadership and management position.
- The head and the collective leadership of the agency or organization shall discuss and consider. If the official is still in good health, retains credibility, and meets the requirements of the position, a consensus vote by secret ballot will be held.
The personnel proposed for extending the tenure in leadership and management positions must achieve a vote share above 50% of the total members of the collective leadership agreeing; in cases where the vote share is exactly 50%, the decision rests with the head of the agency; meanwhile, all differing opinions must be fully reported for the competent authority to review and decide.
The head of the agency or organization shall issue a decision within their authority or present it to the competent authority to review and decide on extending the tenure of leadership and management positions until the retirement age for the official.
