Procedure for Considering the Dismissal from Official Position

According to Article 8 of Regulation 260-QD/TW of 2009, the process for considering the dismissal from office is stipulated as follows:

- Dismissal from office based on Clauses 1 and 2 of Article 4 of this Regulation: The advisory agency submits a proposal to the head or competent authority for decision on dismissal from office in accordance with current laws, statutes, and regulations.

- Dismissal from office based on Clause 3 of Article 4 of this Regulation:

+ The advisory agency, based on the health condition of the official and the conclusion of the Medical Examination Council, proposes and seeks guidance from the head.

+ The advisory agency informs and listens to the official's opinion on the dismissal from office, and then reports to the head.

+ The head considers, decides, or submits to the competent authority for review and decision.
