Notice Required 30 Days in Advance for Resignation?
Clause 1, Article 35 of the Labor Code 2019 stipulates:
Employees have the right to unilaterally terminate the labor contract but must give prior notice to the employer as follows:
- At least 45 days if working under an indefinite-term labor contract;
- At least 30 days if working under a fixed-term labor contract with a term of between 12 months and 36 months;
- At least 3 working days if working under a fixed-term labor contract with a term of less than 12 months;
For certain industries, occupations, and special jobs, the notice period is implemented according to the regulations of the Government of Vietnam.
Thus, ordinarily, employees not working in certain special industries, occupations, and jobs must give notice of resignation as stipulated above. Not all cases of resignation require 30 days' notice.
