What are the regulations for normal working hours from 2021?

Article 105 of the Labor Code 2019 stipulates:

1. Normal working hours shall not exceed 08 hours per day and not exceed 48 hours per week.

2. The employer has the right to arrange the working hours by day or week but must notify the employees; in the case of weekly arrangements, normal working hours shall not exceed 10 hours per day and not exceed 48 hours per week.

The State encourages employers to implement a 40-hour work week for employees.

3. Employers are responsible for ensuring the time limits for working in contact with hazardous or harmful factors comply with national technical standards and relevant laws.

Is it true that the overtime hours of employees should not exceed 50% of normal working hours per day?

Based on Point b, Clause 1, Article 107 of the Labor Code 2019, the regulations on overtime are as follows:

1. Overtime is the amount of working time beyond the normal working hours prescribed by law, collective labor agreements, or internal labor regulations.

2. Employers are allowed to use employees for overtime when the following requirements are fully met:

a) Must have the employee's consent;

b) Ensuring that the employees' overtime does not exceed 50% of the normal working hours per day; in the case of normal working hours arranged by the week, the total normal working hours and overtime hours shall not exceed 12 hours per day; not exceed 40 hours per month;

c) Ensuring that the employees' overtime does not exceed 200 hours per year, except in cases specified in Clause 3 of this Article.
