Is Weekly Rest on Sundays Mandatory?
According to Article 111 of the Labor Code 2019, weekly rest is regulated as follows:
- Each week, the employee is entitled to at least 24 continuous hours of rest. In special cases where the labor cycle does not allow for weekly rest, the employer is responsible for ensuring that the employee receives at least 04 days off per month on average.
- The employer has the right to arrange the weekly rest day on Sunday or another specified day of the week, but it must be recorded in the labor regulations.
- If the weekly rest day coincides with a public holiday as prescribed in Clause 1, Article 112 of this Code, the employee is entitled to take compensatory rest on the next working day.
Therefore, the weekly rest day does not necessarily have to be Sunday as long as the employer can choose another day of the week. However, the company must record the weekly rest day in the labor regulations.
