Is Quitting Without Notice Eligible for Support Under Resolution 116?
According to Resolution 116/ND-CP of 2021 regulating monetary support for employees affected by the COVID-19 pandemic from the surplus of the Unemployment Insurance Fund, the applicable subjects include:
- Employees participating in unemployment insurance as of September 30, 2021 (excluding those working in state agencies, political organizations, socio-political organizations, armed forces units, and public service providers funded by the state budget for regular expenditures).
- Employees who stopped participating in unemployment insurance due to termination of labor contracts or working contracts during the period from January 1, 2020, to the end of September 30, 2021, with unemployment insurance contribution periods reserved according to the employment law, excluding those receiving monthly pensions.
Additionally, Vietnam Social Security has Official Dispatch 3138/BHXH-CSXH of 2021 on determining the subjects eligible for support from the Unemployment Insurance Fund, stating that employees who unilaterally terminate their labor contracts/working contracts in violation of the law (voluntarily leave) will have their applications received until further guidance is issued.
Therefore, in your case of voluntary resignation (voluntarily leaving), your application to receive support from the Unemployment Insurance Fund is currently not being accepted. You may need to follow up and wait for further guidance from the Social Insurance Agency.
