Is it required to pay social insurance for collaborators?
Point a, Clause 1, Article 2 of the 2014 Social Insurance Law states that Vietnamese citizens who are employees under mandatory social insurance participation include:
Employees working under indefinite-term labor contracts, definite-term labor contracts, seasonal labor contracts, or certain job-specific contracts with a duration from full 03 months to less than 12 months, including labor contracts signed between employers and legal representatives of persons under 15 years old as prescribed by labor laws.
Thus, cases that require social insurance contributions for employees are those working under labor contracts (both definite and indefinite terms, seasonal, etc.) for specific jobs with a duration from full 03 months to less than 12 months. However, if both parties do not sign a labor contract, the company is not required to pay social insurance for this collaborator.
