Is It Possible to Dismiss an Employee for Stealing from the Company 10 Months Ago?
Section 1 Article 125 of the 2019 Labor Code stipulates that employees who commit theft at the workplace shall be subject to disciplinary action in the form of dismissal.
Regarding the statute of limitations for handling labor discipline, Section 1 Article 123 stipulates:
The statute of limitations for handling labor discipline is 6 months from the date the violation occurs; in cases where the violation is directly related to finance, property, disclosure of technological secrets, or business secrets of the employer, the statute of limitations for handling labor discipline is 12 months.
...
Therefore, for acts of stealing the company's property, the statute of limitations for handling labor discipline is 12 months from the date the violation occurs. Hence, an employee who stole the company's property 10 months ago is still within the statute of limitations for labor discipline (specifically, disciplinary dismissal).
Sincerely!
