Is it permissible to retain the Citizen Identification Card (CCCD) of an employee when signing an employment contract?
Based on Article 17 of the Labor Code 2019 which stipulates the acts that employers are prohibited from engaging in when concluding and performing labor contracts:
Retaining the original copies of personal identification documents, diplomas, and certificates of the employee.
Requiring the employee to perform any obligation of guarantee by money or other assets for the implementation of the labor contract.
Forcing the employee to perform the labor contract to repay debts to the employer.
=> Thus, according to the legal provisions, the company is not allowed to retain your original Citizenship Identification Card (personal identification document). This action by the company violates the labor legal provisions. Therefore, you have the right to request the company to return your original Citizenship Identification Card.
