Is it permissible to quit during probation?
According to Article 27 of the Labor Code 2019, the provisions on the conclusion of the probationary period are as follows:
- At the end of the probationary period, the employer must inform the employee of the probation results.
In the case where the probationary result meets the requirements, the employer shall continue to execute the employment contract that was concluded in the case of an agreement for probation in the employment contract or must conclude an employment contract in the case of concluding a probation contract.
In the case where the probationary result does not meet the requirements, the concluded employment contract or the probation contract shall be terminated.
- During the probationary period, either party has the right to cancel the probation contract or the concluded employment contract without prior notice and without compensation.
Based on the above regulation, as you are currently a probationary employee, you do not need to provide prior notice and are not required to compensate if you leave abruptly. Therefore, you can resign at any time. Additionally, when you resign, the company will be responsible for paying your probationary wages.
