Is it necessary to notify parents when under-18 employees violate labor discipline?
According to Clause 12, Article 1 of Decree 148/2018/ND-CP stipulating the procedures for handling labor discipline at Article 123 of the Labor Code 2012, the provisions are as follows:
When it is discovered that an employee has committed a violation of labor discipline at the time the violation occurs, the employer shall make a record of the violation, inform the representative organization of the labor collective at the establishment; parents or legal representatives in the case the employee is under 18 years old, to proceed with a meeting to handle labor discipline.
Based on the above provisions, when discovering a violation of labor discipline, your company, besides making a violation record, should then inform the representative organization of the company's labor collective and inform the parents or legal representative in the case of an employee under 18 years old.
