Is it mandatory to establish a labor union?
At Article 170 of the 2019 Labor Code, the regulations on the right to establish, join, and participate in activities of workers' representative organizations at the grassroots level are as follows:
Employees have the right to establish, join, and operate trade unions in accordance with the provisions of the Law on Trade Unions.
Employees in enterprises have the right to establish, join, and participate in activities of employees' organizations at enterprises as provided in Articles 172, 173, and 174 of this Code.
The workers' representative organizations stipulated in Clauses 1 and 2 of this Article are equal in rights and obligations in representing and protecting the legitimate and lawful rights and interests of employees in labor relations.
=> Thus, according to the above regulations, employees are not required to establish a trade union, and the establishment of a trade union is carried out on a voluntary basis.
