Is it correct that employees on unpaid leave only receive 1.8 million VND in Covid support?
According to Clause 3 Article 2 Resolution 09/2021/NQ-HDND on policies, special policies serving the Covid-19 pandemic prevention and control, supporting people affected by the Covid-19 pandemic in Ho Chi Minh City, including:
Policy to support workers who have terminated their labor contracts but are not eligible for unemployment benefits
Workers working at enterprises; production and business establishments; private and public educational institutions, self-financing public educational institutions at the preschool, kindergarten, elementary, middle school, high school levels, and private vocational education institutions (with main offices located in Ho Chi Minh City) who terminate their labor contracts during the period from May 1, 2021, to December 31, 2021; listed in the compulsory social insurance participation list but not eligible for unemployment benefits (excluding cases where workers are not entitled to unemployment insurance according to the Law on Employment 2013 and related guiding documents) => Supported with a one-time payment of 1,800,000 VND/person.
Furthermore, Articles 13 and 14 of Decision 23/2021/QD-TTg (guiding Resolution 68/NQ-CP 2021) also stipulate the support conditions for workers temporarily suspending labor contracts, as follows:
Workers working at enterprises, cooperatives, public service providers that self-finance regular expenses or self-finance investment and regular expenses, private and public educational institutions at the preschool, kindergarten, elementary, middle school, high school, vocational education levels (hereinafter referred to as enterprises, cooperatives, public service providers, educational institutions) who must temporarily cease operations as required by the competent state authority to prevent and control the COVID-19 pandemic will be supported when meeting the conditions as follows:
- 3,710,000 VND is for cases where workers suspend labor contracts or take unpaid leave for more than 30 days;
- 1,855,000 VND is for cases where workers suspend labor contracts or take unpaid leave from 15 days to less than 30 days;
Thus, Resolution 09 only supports workers in Ho Chi Minh City, while Resolution 68 supports all workers facing difficulties due to the impact without distinguishing provinces or cities.
Clause 6 Article 44 of Decision 23 further guides that individuals simultaneously eligible for support policies under this Decision and local support policies can only receive the highest support policy.
Therefore, if eligible for both supports, you will only be entitled to Resolution 68 with a support level of 3,710,000 VND (unpaid leave of more than 30 days).
